Terms of Service

By accessing or using Snap CD ("Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.
2. Service Description
Snap CD provides an infrastructure-as-code deployment platform. Current features and capabilities are described on our website.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
3.1 Communications
By creating an account, you consent to receive service-related communications from us, including account notifications, security alerts, billing information, and updates to these Terms or our policies. These communications are part of the Service and cannot be opted out of while maintaining an account.
4. Acceptable Use Policy
4.1 Prohibited Activities
You agree NOT to use the Service to:
- Violate any laws or regulations
- Deploy malicious infrastructure or code
- Infringe on intellectual property rights
- Transmit viruses or harmful code
- Attempt to gain unauthorized access to systems
- Interfere with or disrupt the Service
- Use excessive resources that impact other users
- Cryptocurrency mining or related computational activities
- Spam distribution or phishing infrastructure
- Reselling or sublicensing the Service without authorization
4.2 Resource Limits
To ensure fair usage for all customers, resource limits apply based on your subscription plan, including API rate limits and storage limits. Current limits are available on our pricing page.
4.3 Enforcement
We reserve the right to:
- Suspend or throttle accounts that exceed resource limits
- Terminate accounts engaged in prohibited activities
- Report illegal activities to appropriate authorities
- Cooperate with law enforcement investigations
5. Subscription and Payment
5.1 Subscription Plans
We offer various subscription plans with different features and limits. The Community edition is free, while paid plans require a valid payment method.
5.2 Billing
Paid subscriptions are billed monthly or annually in advance. All payments are processed securely through Stripe. You authorize us to charge your payment method for all fees associated with your subscription.
5.3 Refunds
All subscription fees are non-refundable except as required by applicable law. You may cancel at any time, and your subscription will remain active until the end of the current billing period.
5.4 Metered Billing
In addition to base subscription fees, certain usage is billed on a metered basis:
- Module-Months: Usage is calculated based on how long each module exists during a billing period, summed across all modules, and rounded up to the nearest whole module-month.
- User-Months: Usage is calculated based on how long each user is active during a billing period, summed across all users, and rounded up to the nearest whole user-month.
Metered usage is calculated at the end of each billing period and invoiced within 3 business days. Current pricing for metered usage is available on our pricing page.
5.5 Price and Plan Changes
We may modify subscription prices, metered rates, and included subscription limits (such as included modules and users) with reasonable advance notice. Changes take effect at the start of your next billing cycle following the notice period. For annual subscriptions, changes apply at renewal.
We may modify fair usage limits (such as API rate limits, concurrent job limits, job duration, and storage limits) at any time without notice to ensure platform stability and fair access for all customers.
6. Intellectual Property
6.1 Our Property
The Service and its original content, features, and functionality are owned by Snap CD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Content
You retain ownership of your configurations. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide the Service to you.
7. Customer Data
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. This section describes how we handle your infrastructure data specifically.
7.1 Definition
"Customer Data" means infrastructure-related data you provide or generate through the Service, including:
- Module configurations, including links to Git references (but not the actual code)
- Secrets you provide for deployments
- Outputs generated by your deployments
- Deployment logs and execution history
7.2 Data Processing
We process Customer Data solely to provide the Service, including:
- Executing deployments and infrastructure changes
- Storing and managing state files
- Providing deployment logs and audit trails
- Generating usage metrics for billing
7.3 Secrets Management
Secrets you provide for deployments, as well as sensitive outputs are encrypted at rest in an external vault.
7.4 Data Residency
By default, Customer Data is stored in our primary region. Enterprise customers may request specific data residency requirements subject to availability and additional terms.
8. Service Availability
We strive to maintain high availability of the Service and perform regular backups. However, we do not guarantee specific uptime levels unless separately agreed in an enterprise contract.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAP CD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Snap CD and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for:
- Breach of these Terms
- Non-payment of fees
- Suspected fraudulent or illegal activity
- Upon your request
Upon termination, your right to use the Service will cease immediately. You may download your data for 30 days after termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Snap CD is incorporated, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snap CD regarding the Service and supersede all prior agreements and understandings.
17. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
18. Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiations. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction as specified in the Governing Law section.
19. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of all or substantially all of our assets.
20. Beta Features
We may offer beta, preview, or experimental features ("Beta Features") for testing purposes. Beta Features are provided "as is" without warranty, may contain bugs or errors, and may be discontinued at any time without notice. Your use of Beta Features is at your sole risk.
By using Snap CD, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
